Martinez, upon entry of his guilty plea, of criminal sale of a controlled substance in the second degree, and sentencing him to an indeterminate term of from five years to life in prison, unanimously modified, on the law, to vacate the sentence imposed and remand the matter for resentencing in accordance with the sound discretion of the sentencing court, with the further direction that if in its exercise of discretion the sentencing court reduces the previously negotiated sentence, the People shall be given the opportunity to withdraw their consent to the plea, and except as modified, affirmed.
